| International terrorism has been a prominent feature of global public discourse for some time, with the threat it poses to international peace and security frequently highlighted. In order to address this threat, states have adopted a variety of measures, with no universally accepted or standardized definition of terrorism. This is due to the inherent structure of the international state system, which allows for a vast field of interpretation in defining what constitutes a terrorist or a terrorist organization. There are several reasons why states are unable to agree on a definition of terrorism. One of the most significant reasons is the structure and principle of the international state system, namely the concept of sovereignty. The principle of sovereignty represents the system’s fundamental tenet and the primary regulatory code. Until the mid-19th century, the state system was constructed upon the principles of sovereignty and natural justice, which served as a mediator between sovereign entities and the entire system. The equilibrium within the system, or, to use another term, the “hierarchy of norms,” was maintained through this dichotomy. However, from the 19th century onward, the principle of sovereignty replaced that of “natural justice” and transformed it into a principle that could only be understood and described in terms of “sovereignty.” Consequently, all concepts, including those of justice, were interpreted in accordance with the principle of sovereignty and within its purview.
